VIRTUAL LEARNING STUDENT CODE OF CONDUCT
Students who are enrolled in Cameron Parish School System’s Virtual Learning Program are expected to comply with all discipline standards and procedures outlined and defined in the 2020-2021 Student Code of Conduct. Standards of conduct are just as important in the virtual program as they are on physical school campuses.
To ensure that all students and their families understand the behavioral expectation for the virtual program, we have developed the following discipline guidelines and procedures to address students’ online interactions with Cameron Parish School System faculty, staff, other students, as well as students’ individual actions.
These guidelines and procedures are in addition to the existing Student Code of Conduct, including those related to acceptable use, social media, electronic communications, and data security. The following expectations apply to all Virtual Learning platforms used by Cameron Parish School System and synchronous (live) and asynchronous lesson environments.

Consequences adhere to discipline standards as prescribed by Louisiana State law. Only suspensions and expulsions can be appealed.

Consequences adhere to discipline standards as prescribed by the Children’s Internet Protection Act, La. Rev. Stat. Ann. §17:100.6, and La Rev. Stat. Ann. §17:416.
Any violation may include temporary or permanent loss of privileges and civil/criminal liability under other applicable laws.
A (**) denotes consequences for grades K-5 shall range from actions as specified on the School Behavior Report to suspension or expulsion recommendation in cases of repeated and/or serious offenses unless otherwise specified. For monetary damages, restitution should be considered as a consequence.

DUE PROCESS
For Suspension Appeal at School Level:
The principal or principal’s designee not involved with the case shall conduct a new investigation of the suspension. Interviews of additional witnesses (if applicable) and information gathered from the appeal documentation are used to determine if the appeal is to be upheld or denied.
If the appeal is upheld the process ends and the suspension is removed from the student’s records. Notification of the removal shall be sent to the Child Welfare and Attendance Department.
For Suspension Beyond the Principal Level:
The principal shall forward the denied suspension appeal form to the Child Welfare and Attendance Department with two days.
The Supervisor of Child Welfare and Attendance shall review the facts of the appeal.
A hearing shall be scheduled within 5-10 school days and the parent/guardian will be notified by certified mail of the hearing date, time and place.
The student will be permitted to return to school once an appeal is filed.
The principal/designee shall be present at the suspension appeal hearing to present the school’s case.
The decision of the Hearing Officer is final.
EXPULSION:
Louisiana law states any student after a third suspension shall on a fourth such suspension from school be recommended for expulsion.
The principal may recommend a student at any time for expulsion if the offense is of such serious nature as to deny other student’s safety and the school’s ability to conduct business in an orderly fashion.
Any student’s conviction of a felony or incarceration for an act, which had it been committed by an adult would be a felony, shall be cause for expulsion.
For Expulsion at School Level:
A recommendation for expulsion is made by the principal. For IDEA and 504 eligible students, a manifestation determination must be completed prior to administrative recommendations. This form along with the expulsion documents are forwarded to the Child Welfare and Attendance Department.
A hearing date, time and place will be scheduled.
Notification of student’s right to counsel will be given.
Notification will be sent to parent/guardian by certified mail.
Parent/legal guardian will notify Child Welfare & Attendance Dept. if their child will be represented by legal counsel at the expulsion hearing.
A hearing is conducted by the Superintendent/designee.
A determination of whether to expel the student is made by the Superintendent/designee.
The principal/designee shall be present at the expulsion hearing to present the school’s case.
A school employee may be represented by an employee advocate of the Superintendent’s choice at this hearing. An aggrieved employee has the right to the advocate for consultation and/or representation at the expulsion hearing.
Until the hearing takes place, the student shall remain suspended.
For Expulsion Beyond School Level:
The parent or guardian of the student may request in writing to the Superintendent that the School Board review the findings of the Superintendent or his designee within 5 working days after the decision to expel and the consequence determination have been received. Otherwise, the decision of the Superintendent shall be final.
The School Board, in reviewing the case, may affirm, modify, or reverse the action previously taken.
If the School Board upholds the decision of the Superintendent, the parent or guardian of the student may, within 10 days, appeal to the Cameron Parish District Court.
Until the hearing takes place, the student shall remain suspended.
NOTE: Expelled students may not attend any school-sponsored activity on any school campus, unless approved by the school principal.
